CalMind Terms of Use

These Terms form an agreement between you and Gaomi Fanxing Network Technology Co., Ltd. (高密市繁星网络科技有限公司), Dongbeixiang Cultural Development Zone, Gaomi City, Weifang City, Shandong Province, China, the operator of CalMind. By creating an account or using CalMind, you agree to these Terms. If you do not agree, do not use the service.
1. The service
CalMind provides photo-based meal analysis, nutrition and potential-allergen estimates, food and activity logs, heart-rate recording, daily and historical trends, friend weight tracking, community and recipe features, Apple Health synchronization, accessibility guidance, online coaching where available, and optional subscriptions. Features may differ by device, plan, language, or region and may change as the service develops.
2. Eligibility and accounts
You must be at least 16, or the minimum age at which you may lawfully agree to these Terms in your location. If parental consent is legally required, a parent or guardian must provide it. Provide accurate account information, keep credentials secure, and notify us of suspected unauthorized access. You may not sell, transfer, or share an account in a way that compromises another person's data.
3. Estimates, health information, and emergencies
Food, portion, calorie, nutrient, allergen, activity, and heart-rate outputs are estimates and may be incomplete or wrong. CalMind is a wellness tool, not a medical device, emergency service, diagnostic service, or substitute for a physician or registered professional. Do not use an allergen estimate to decide whether food is safe, and do not delay medical care because of CalMind. For an emergency or concerning symptom, contact local emergency services or a qualified clinician.
4. Acceptable use
Use CalMind lawfully and only for accounts and content you are authorized to use. Do not attempt unauthorized access, scrape or reverse engineer the service except where law expressly permits, upload malware, disrupt the service, impersonate others, harass users, promote dangerous conduct, infringe rights, or submit unlawful, deceptive, discriminatory, sexually exploitative, or violent content. Do not share another person's health or weight information without permission.
5. Your content and the community
You keep ownership of photos, recipes, posts, comments, and other content you submit. You grant CalMind a non-exclusive, worldwide, royalty-free license to host, reproduce, process, adapt for technical display, and show that content only as needed to operate, secure, and improve the service and provide the sharing choices you select. The license ends when the content is deleted, except for limited backups, legal or safety records, and copies independently made or reshared by others. We may restrict or remove content and accounts that violate these Terms, and may preserve evidence where required for safety or law.
6. Apple Health and third-party services
Apple Health integration is optional and subject to your device permissions and Apple's terms. Revoking permission stops future access but does not automatically erase data previously imported into CalMind. Third-party stores, sign-in services, links, and devices are governed by their own terms. CalMind is not responsible for a third party's independent service, but this does not limit rights that cannot legally be waived.
7. Subscriptions, renewal, cancellation, and refunds
Price, billing period, trial terms, features, and automatic-renewal details are shown before purchase. Unless you cancel in the applicable app-store subscription settings before renewal, a subscription may renew and the store may charge the selected payment method. Deleting the App or account does not necessarily cancel a store subscription. Manage cancellation and refund requests through the store that processed the purchase. Refunds follow that store's rules and any mandatory consumer law; nothing in these Terms removes a statutory refund, withdrawal, or cancellation right.
8. Privacy and deletion
Our Privacy Policy explains data processing, retention, sharing, international transfers, and your rights. You can delete individual records or request account deletion through Me → Account & Security → Delete Account or Delete Account. Deletion is subject to the retention limits described in the Privacy Policy and does not cancel an app-store subscription or erase data held independently by Apple Health or other users.
9. CalMind intellectual property
CalMind and its software, design, trademarks, and service content—excluding user content and third-party materials—are owned by or licensed to the operator. We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the service under these Terms. No other rights are granted.
10. Availability, changes, and termination
We may maintain, update, suspend, or discontinue features for security, legal, technical, or business reasons. When reasonably possible, we will give notice of a material adverse change. You may stop using CalMind and delete your account. We may suspend or terminate access for a serious or repeated breach, security risk, legal requirement, or misuse, and will provide notice or an appeal opportunity when required by law.
11. Warranties and liability
CalMind is provided with reasonable care but, to the extent permitted by law, without a promise that every estimate, feature, or connection will be uninterrupted or error-free. You remain responsible for decisions based on estimates and for backing up content important to you. To the extent permitted by law, neither party is liable for indirect or unforeseeable loss. Nothing excludes liability or rights that cannot lawfully be excluded, including liability for fraud, willful misconduct, gross negligence, or death or personal injury where applicable.
12. Governing law, changes, and contact
These Terms are governed by the laws of the People's Republic of China, without depriving a consumer of mandatory protections or access to courts available in the consumer's habitual residence. Contact us first so we can try to resolve a dispute; either party may then use a court or authority with lawful jurisdiction.
